Terms of use

1. General

  1. These terms ("Terms") govern the use of the website at babilamluxury.com (the "Website") and the services provided electronically through it. They are issued under Article 8 of the Polish Act of 18 July 2002 on Providing Services by Electronic Means.
  2. The service provider and owner of the Website is Wojciech Kordas Prime Advertising, ul. Liściasta 33, 33-111 Koszyce Wielkie, Poland, VAT ID: PL6871402124 (the "Provider"). Contact: office@babilam.com, phone +48 731 467 936. BABILAM is a brand of the Provider.
  3. These Terms are available free of charge on the Website in a form that can be downloaded, saved and printed.
  4. A "User" is anyone using the Website. Using the services requires reading and accepting these Terms.

2. Services

  1. The Provider offers the following free electronic services:
    • browsing the Website — access to information about the collection, the atelier and journal articles;
    • contact form — sending an enquiry or a request for a quote, spec sheet or custom commission;
    • trade application form — for interior designers, architects and other professionals;
    • newsletter — news about new pieces and updates sent to your email address.
  2. The Website is informational. No sales take place and no sales contracts are concluded through it. Content on the Website, including product descriptions and photographs, is not an offer within the meaning of Article 66 of the Polish Civil Code but an invitation to negotiate (Article 71).
  3. Orders are fulfilled on the basis of a separate quotation and contract agreed individually with the Provider, including by email. Such contracts are governed by their own terms and by mandatory law, in particular consumer-protection law.
  4. Because every piece is made by hand, each lamp is unique. Photographs show example pieces; glass texture, bubbles and tone may vary. This is not a defect.

3. Technical requirements

  1. To use the Website you need an internet-connected device, a current web browser (e.g. Chrome, Safari, Firefox, Edge) with JavaScript enabled, and — for the newsletter and forms — an active email address.
  2. Remembering your cookie choices requires your browser to allow local storage. See the Privacy & cookie policy.

4. Starting and ending the service

  1. The browsing service starts when you open any page of the Website and ends when you close it.
  2. The contact and trade application services start when you submit a form and end when the Provider responds or the correspondence ends.
  3. The newsletter service starts when you subscribe and continues for an indefinite period. You may end it at any time, free of charge and without giving a reason, via the unsubscribe link or by writing to office@babilam.com.
  4. The Provider may terminate a service with 7 days' notice, or immediately if the User breaches section 5.
  5. Trade accounts are granted at the Provider's discretion after review. Trade terms, including discounts and payment terms, are set out in a separate agreement.

5. User obligations

  1. Users must use the Website lawfully, in accordance with these Terms and good practice.
  2. Users must not submit unlawful content — including offensive content or content that infringes the rights of others — send unsolicited commercial communications (spam), or provide false information.
  3. Users must not take actions that may disrupt the Website, in particular unauthorised access attempts, large-scale automated scraping or the introduction of malicious software.

6. Intellectual property

  1. All Website content — in particular texts, photographs, product designs, and the BABILAM logo and mark — belongs to the Provider or is used with the rights holders' consent and is legally protected.
  2. Copying, distributing or using Website content for purposes other than personal use requires the Provider's prior written consent. Professionals with a trade account may use materials provided to them in presentations to their clients, keeping the BABILAM brand attribution.

7. Risks of using electronic services

As required by Article 6 of the Act on Providing Services by Electronic Means, we inform you that using the internet involves risks such as malware, phishing (impersonation of senders), interception of data on unsecured networks, and spam. The Website is served over encrypted HTTPS. We recommend up-to-date software and antivirus protection, and caution with messages that claim to come from us — we never ask for passwords or card details by email.

8. Liability

  1. The Provider makes every effort to keep the Website available and error-free but may need technical breaks, in particular for maintenance or because of the hosting provider.
  2. Information on the Website, including lead times, is indicative; binding terms are set out in the individual quotation.
  3. Nothing in this section excludes or limits the Provider's liability to consumers where mandatory law does not allow it.

9. Complaints

  1. Complaints about the Website or its electronic services may be sent to office@babilam.com or by post to the Provider's address.
  2. A complaint should include your contact details, a description of the problem and how you would like it resolved.
  3. The Provider will review complaints within 14 days of receipt and reply in the same way the complaint was sent, unless you ask otherwise.
  4. Complaints about ordered products are handled under the relevant contract and the statutory warranty or guarantee provisions.

10. Personal data and cookies

How we process personal data and use cookies is described in our Privacy & cookie policy.

11. Final provisions

  1. These Terms are governed by Polish law. This choice of law does not deprive consumers of the protection of the mandatory provisions of the country where they habitually reside.
  2. Disputes with businesses will be settled by the court competent for the Provider's registered address. Disputes with consumers will be settled by the courts competent under general rules. Consumers may also use out-of-court dispute resolution available in their country.
  3. The Provider may amend these Terms for important reasons, in particular changes in the law or in the services. Changes take effect 7 days after publication on the Website; newsletter subscribers will be informed by email. Users who do not accept the changes may end the service under section 4.
  4. Matters not covered by these Terms are governed by Polish law, in particular the Civil Code and the Act on Providing Services by Electronic Means.
  5. In case of discrepancy between the Polish and English versions, the Polish version prevails.
