Privacy & cookie policy
This policy explains how personal data is processed on babilamluxury.com (the "Website") and how we use cookies and similar technologies. It is provided under Articles 13 and 14 of Regulation (EU) 2016/679 (GDPR) and the Polish Electronic Communications Law (Prawo komunikacji elektronicznej). A Polish version is also available; in case of discrepancy the Polish version prevails.
1. Controller
The controller of your personal data and the operator of the Website is Wojciech Kordas Prime Advertising, ul. Liściasta 33, 33-111 Koszyce Wielkie, Poland, VAT ID: PL6871402124 (the "Controller", "we"). BABILAM is a brand of the Controller.
Contact on any data-protection matter: office@babilam.com, phone +48 731 467 936, or by post to the address above. We have not appointed a Data Protection Officer.
2. What we process, why, and on what legal basis
- Enquiries (contact form, email, phone) — name, email, optional phone number, the lamp you are interested in and your message. Purpose: answering you and preparing quotes or proposals. Basis: steps taken at your request before entering into a contract (Art. 6(1)(b) GDPR) and our legitimate interest in responding to correspondence (Art. 6(1)(f)).
- Trade applications — name, studio or company, email, phone, website, business type, country, VAT/tax ID and information about your practice and projects. Purpose: verifying that you are a design professional and running your trade account. Basis: Art. 6(1)(b) and (f) GDPR.
- Newsletter — email address. Purpose: sending news about new pieces and stories from the workshop. Basis: your consent (Art. 6(1)(a) GDPR). You can withdraw consent at any time via the unsubscribe link or by writing to us; this does not affect processing carried out before withdrawal.
- Orders and invoicing — where an enquiry leads to an order: data needed to fulfil the contract, deliver, invoice and handle complaints. Basis: Art. 6(1)(b) and our legal obligations under tax and accounting law (Art. 6(1)(c)).
- Claims — data needed to establish, exercise or defend legal claims. Basis: our legitimate interest (Art. 6(1)(f)).
- Technical logs and security — when you visit the Website our hosting provider automatically processes your IP address, browser type, the date and time of the request and the pages requested. Purpose: delivering the Website, its security and preventing abuse (including spam protection for forms). Basis: our legitimate interest (Art. 6(1)(f)).
- Cookie preferences — your consent choices. Basis: Art. 6(1)(c) GDPR in connection with the obligation to obtain and demonstrate consent.
Providing data is voluntary, but without the fields marked as required we cannot answer your enquiry, review your application or send the newsletter.
3. Recipients
We share data only with service providers who process it on our behalf and under our instructions, under data-processing agreements:
- Netlify, Inc. (USA) — website hosting and storage of form submissions (Netlify Forms);
- our email and telephone service providers;
- accounting, IT and legal advisers, where needed;
- couriers and freight forwarders, when an order is shipped to you.
We may also disclose data to public authorities where the law requires it. We do not sell personal data.
4. Transfers outside the European Economic Area
Netlify, Inc. is based in the United States, so data may be transferred outside the EEA. Such transfers are based on an adequacy decision of the European Commission (the EU-US Data Privacy Framework) where the recipient is certified under it, or otherwise on the European Commission's Standard Contractual Clauses (Art. 46(2)(c) GDPR). You may request a copy of the safeguards by writing to office@babilam.com.
5. How long we keep data
- Enquiries that do not lead to an order — up to 24 months from our last contact.
- Trade accounts — for the duration of our cooperation, then until the relevant limitation periods for claims expire.
- Order and invoice data — for 5 years from the end of the calendar year in which the tax obligation arose, as required by tax law.
- Newsletter — until you withdraw consent.
- Technical logs — for the period set by our hosting provider, needed to keep the Website secure.
- Cookie preferences — 12 months.
6. Your rights
You have the right to: access your data and receive a copy; rectify it; have it erased; restrict processing; data portability; object to processing based on our legitimate interest (and, at any time, to direct marketing); and withdraw consent at any time without affecting the lawfulness of earlier processing. To exercise a right, write to office@babilam.com. We will reply within one month.
You also have the right to lodge a complaint with the supervisory authority: the President of the Personal Data Protection Office (Prezes Urzędu Ochrony Danych Osobowych), ul. Stawki 2, 00-193 Warszawa, Poland — or with the authority in your EU country of residence.
7. Automated decisions
We do not make decisions based solely on automated processing, including profiling, that produce legal effects for you.
8. Cookies and similar technologies
Cookies are small files saved on your device by a website; similar technologies such as the browser's local storage work in the same way. Under the Polish Electronic Communications Law, we may store information on your device without consent only where it is strictly necessary to provide the service you asked for. Anything else requires your prior, informed consent.
We group storage into three categories:
- Necessary — required for the Website to work and to remember your choices. Always active.
- Analytics — would help us understand how the Website is used. Off unless you switch them on.
- Marketing — would allow social-media or advertising features. Off unless you switch them on.
What we currently store:
| Name | Purpose · type · lifetime |
|---|---|
| babilam_consent | Remembers your cookie choices so we do not ask again. Strictly necessary · local storage on your device, first-party · 12 months, then we ask again. |
That is the only item this website currently stores on your device. We do not use analytics, advertising or social-media tracking cookies. If we add any in the future (for example visitor statistics), they will be listed here and will only run after you switch them on in Cookie settings.
Managing your choices
You can change or withdraw your consent at any time in Cookie settings (also linked in the footer of every page). You can also delete or block cookies and local storage in your browser settings; blocking necessary storage means we will ask about cookies on every visit.
9. External links
The Website links to our Instagram profile. Clicking the link takes you to a service operated by Meta Platforms Ireland Ltd., which processes data under its own privacy policy. We do not embed Instagram content or tracking pixels on the Website.
10. Children
The Website is intended for adults and professionals. We do not knowingly collect data from children under 16.
11. Changes
We may update this policy when the law, our services or the tools we use change. The current version is always published on this page with its effective date.
